GENERAL TERMS AND CONDITIONS APPLICABLE TO USERS OF THE EVENTSTUR PLATFORM EVENTSTUR 

These general service provision terms, including their annexes (the “Terms”), supplemented by the EVENTSTUR policies published on EVENTSTUR (the “Policies”), govern the terms of use of the platform and are also an integral part of the Collaboration Agreement with providers and service suppliers (together with the Terms and the Policies, the “Agreement”), entered into by the Provider and EVENTSTUR (each, a “Party” and together, the “Parties”).

1.1 Glossary (Annex: GLOSSARY) 

1.2 How We Work (explanation of the platform’s operations — Annex: HOW WE WORK) 

In addition to the terms defined in other sections of this Agreement, the following definitions shall apply throughout this Agreement, unless otherwise stated herein. 

 

2.OBLIGATIONS OF THE PROVIDER / SERVICE SUPPLIER 

2.1 Provider Information – Service Supplier 

2.1.1 The Provider or Service Supplier shall provide its information in accordance with the collaboration agreement, the Service Provision Policies, and these General Terms and must comply with the formats and standards provided by evenstur360.com. EVENTSTUR reserves the right to modify or remove any information that is incorrect, incomplete, or violates the Collaboration Agreement or its supporting documents. 

2.1.2 The Provider declares and guarantees that the Service Information will be true and accurate and not misleading. The Provider is responsible for ensuring the Service Information is correct, complete, and up to date, including availability for specific periods or extraordinary situations (e.g., sick leave, renovations, or construction on or near the premises). The Provider will update the Service Information as often as required, either directly online via the Extranet, through a Connectivity Provider (where applicable and available), or by any other means EVENTSTUR may specify from time to time. EVENTSTUR will process any changes, updates, or modifications requiring its validation as promptly as possible. 

2.1.3 All information provided by the Provider for the Platform shall at all times remain the exclusive property of the Provider. However, EVENTSTUR may modify and subsequently translate such information into other languages. These translations shall remain the exclusive property of EVENTSTUR at all times. The modified and translated content is intended solely for use by EVENTSTUR on the Platform and may not be used by the Provider on any other distribution or sales channel for any purpose whatsoever. No changes or updates to the descriptive information provided by the Provider may be made without prior written consent from EVENTSTUR. Additionally, services such as the 360º tour, photos, videos, and other services contracted by EVENTSTUR may only be used within the portal and never externally. 

2.1.4 The rates offered by the Provider to evenstur360.com must be at least equal to those offered through other channels. Otherwise, if EVENTSTUR finds that the rates offered through its platform are higher than those on other channels, it may notify the Provider to correct the rate. If the Provider does not accept the correction, EVENTSTUR may suspend the Provider’s specific offer until it complies with these terms. 

2.1.5 EVENTSTUR may offer its users and/or clients an incentive regarding the Provider’s Service Price at its own expense. In such cases, EVENTSTUR may pay part of the Service Price on behalf of the Customer. 

2.1.6 The Provider shall supply EVENTSTUR with the temporary availability of its products and services and is encouraged to provide EVENTSTUR with equitable access to all its services, types of services, and available rates during both peak and off-peak periods. 

 

2.2 Commission 

2.2.1 For each service booking made by a Customer through the Platform, the Provider shall pay EVENTSTUR a commission (the “Commission”). 

2.2.2 Commission Calculation: The total Commission per booking shall be equal to the product of: 

(i) the number of Provider services booked by the Customer; 

(ii) the base price of each service, plus any service extras invoiced by the Provider to the Customer, without the applicable Value Added Tax or any other similar sales tax; 

(iii) the number of services booked by the Customer; 

(iv) the Commission percentage established in the agreement (without taxes where applicable). 

2.2.3 Commission Calculation and Payment in Cases Where the Service is Not Rendered Due to Customer Fault: 

(i) If the Customer paid for the Service through EVENTSTUR, and there is a “no-show” or cancellation by the Customer, EVENTSTUR will transfer the payment made by the Customer to the Provider, deducting its Commission beforehand. The Commission will be calculated based on the confirmed booking as provided to the Provider and confirmed to the Customer. 

(ii) If the Customer paid the Service directly to the Provider, and there is a “no-show” or cancellation by the Customer, the Provider shall transfer the amount paid by the Customer to EVENTSTUR and pay the corresponding Commission. 

In both cases, any claims filed by the Customer shall be the sole responsibility of the Provider, with complete indemnity for EVENTSTUR. 

2.2.4 Commission Calculation and Payment in Cases Where the Service is Not Rendered Due to Provider Fault: 

(i) If the Customer paid for the Service through EVENTSTUR and there is a “no-show” or cancellation by the Provider, EVENTSTUR will transfer the payment made by the Customer to the Provider, deducting its Commission beforehand. The Commission will be calculated based on the confirmed booking as provided to the Provider and confirmed to the Customer. 

(ii) If the Customer paid the Service directly to the Provider and there is a “no-show” or cancellation by the Provider, the Provider shall transfer the amount paid by the Customer to EVENTSTUR and pay the corresponding Commission. 

 

3.CUSTOMER BOOKINGS 

3.1. The Provider will receive a confirmation for each booking made by a Customer through the Platform. The confirmation will include the customer’s data, including, among others, all personal customer data. EVENTSTUR is not responsible for the accuracy and completeness of the information (including credit card details) and dates provided by the Customers. EVENTSTUR is not liable for the Customers’ payment obligations related to their bookings. The Provider shall regularly check and verify (at least once a day) the status of the bookings on the Extranet, through its Connectivity Provider (as applicable and available), or in any other way EVENTSTUR may indicate from time to time. EVENTSTUR will only retain credit card data for a limited period of time. 

3.2. From the moment a booking is made through the Platform, a direct legal contractual relationship is established between the Provider and the Customer (the “Customer Booking”). EVENTSTUR is not part of this contractual relationship. 

  1. I) Direct bookings: These do not require confirmation by the Provider; the booking confirmation is direct and depends on the booking type and applied cancellation policies.
  2. II) Non-direct bookings: The Provider has the right to reject or accept bookings from the Customer.

3.3. The Provider must accept the Customer as a contractual counterpart and must manage the booking online in accordance with the Service Information contained on the Platform at the time of the booking, as well as with any additional information and requests (if any) expressed by the Customer. 

3.4. The Provider may not charge the Customer any additional or operational or administrative fees for the use of any payment method (e.g., credit card charges) other than the amounts of the fee and the additional charges and surcharges stated in the booking confirmation by EVENTSTUR to the Customer. 

 

4.LEGITIMATE REASONS FOR REJECTION AND CANCELLATION OF BOOKINGS BY THE PROVIDER 

4.1. The Provider shall provide the services booked to the Customer. If the Provider cannot fulfil its obligations, it must immediately inform the Customer and adhere to the cancellation consequences. 

4.2. Cancellations made by Customers before the time at which a cancellation fee is applicable will not accrue Commission. Cancellations made by Customers after that time will accrue Commission. 

4.3. Legitimate reasons for rejecting bookings based on the data published on the platform by the Provider: Upon receiving a service request from a potential Customer, the following shall be considered legitimate reasons for the Provider to reject the booking: 

(i) An erroneous price of the service listed on the platform; 
(ii) Lack of availability on the date requested by the Customer; 
(iii) The event proposed by the Customer not matching the characteristics of the service offered by the Provider; 
(iv) Failure of the Customer to provide the minimum essential information to confirm the booking; 
(v) Request by the Customer for services not offered by the Provider; 
(vi) For services provided outdoors, adverse weather conditions that prevent the service from being delivered under normal conditions; 
(vii) Logistical and/or transportation issues that prevent the service from being provided; 
(viii) Force Majeure causes (emergencies, government-imposed mobility restrictions, etc.); 
(ix) Any other reason similar to the above that prevents the service from being provided, provided it is fully justified by the Provider to both EVENTSTUR360.com and the Customer. 

4.4. Legitimate reasons for cancelling a booking by the Provider: The Provider may only cancel a previously reserved service with a minimum notice of 72 hours before the start time and exclusively due to the occurrence of one of the following reasons: 

(i) A duly justified technical or logistical failure that prevents service delivery; 
(ii) Illness or physical unavailability of the Provider; 
(iii) Closure of the venue or reserved space; 
(iv) Issues with the legal documentation or necessary licenses to deliver the service; 
(v) Scheduling conflict due to a planning error in service delivery; 
(vi) Inadequate conditions for delivering the service; 
(vii) Breach by the Customer (non-payment, changes in the characteristics of the requested service, etc.); 
(viii) Issues with the equipment or materials required for the service; 
(ix) Security risks or inappropriate behavior by the Customer; 
(x) Force Majeure causes (emergencies, government-imposed mobility restrictions, etc.); 
(xi) Any other reason similar to the above that prevents the service from being provided, provided it is fully justified by the Provider to both EVENTSTUR360.com and the Customer. 

4.5. Penalties: The rejection and/or cancellation of bookings by the Provider may lead to the application of penalties under the terms established in the section “Terms and Conditions”. 

CLAIMS SUBMITTED BY THE PROVIDER 

5.1. The Provider must handle any complaint or claim submitted by the Customer independently and with full indemnity for EVENTSTUR360.com, without requesting the involvement of EVENTSTUR, which shall not be held liable and is expressly exempt from any responsibility in relation to such complaints or claims. However, in such cases, EVENTSTUR may, at its sole discretion: 

(i) offer support services to the Provider; 
(ii) act as an intermediary between the Provider and a Customer; and 
(iii) provide compensation to the Provider. 

5.2. Claims submitted by the Provider or event organizer: In the event of claims from the Provider or event organizer against the Customer (for example, in case of damage to materials used for service delivery), EVENTSTUR will manage the incident between both parties, resulting in: 

(i) If the Customer does not accept responsibility, this will be communicated to the Provider, and EVENTSTUR may, if deemed appropriate, carry out any commercial actions it considers necessary with respect to both parties in order to preserve the quality of its service, or simply disclose the situation so that the Provider may take the legal actions it deems appropriate, with full indemnity for EVENTSTUR. 

(ii) If the Customer accepts responsibility, the compensation amount claimed by the Provider or agreed upon by both parties may be processed through the platform within a maximum of 14 days from the acceptance of responsibility. 

In both cases, EVENTSTUR will still be entitled to receive its commission for its role in the transaction. 

Any type of claim must be submitted through the platform within a maximum period of 15 days from the moment the incident giving rise to the claim occurs. The platform has a section called “Claim” where a claim “ticket” is created with the description of the events giving rise to the complaint, which is then notified to the recipient (Customer or Provider). 

EVENTSTUR’s involvement in the handling and processing of complaints and/or claims from Providers is limited to providing the Parties with a communication channel, and the platform is exempt from any liability arising from the incident. 

 

5.CUSTOMER OBLIGATIONS 

6.1. The Customer agrees to provide accurate and necessary information required for the provision of services by the Provider in a truthful and correct manner, so that the service delivery meets their expectations and the highest possible quality standards within the contracted rates. 

6.2. Booking types and procedures from the customer’s perspective: 

6.6.1. Confirmed booking (direct booking): If the Provider offers direct booking through the Platform, the booking will be confirmed and paid (if applicable) under the corresponding cancellation policies. 

6.6.2. Booking on request (non-direct booking): This procedure requires a second step by the Provider consisting of the acceptance of the booking. Payment will be made at the time of the request: 

(i) In case of acceptance, the payment will be confirmed; 
(ii) In case of rejection, the amount will be automatically refunded with express confirmation. 

6.6.3. 24-hour hold booking: It is possible to reserve and block a service’s availability on the platform for 24 hours, pending final reservation or hiring. The same service may only be reserved and blocked a maximum of 3 times within 1 month. 

6.6.4. Cart: Reserved services may be placed in a personal cart, without blocking the service’s availability (meaning it can still be booked by other users) and without notifying the Provider. 

 

LEGITIMATE GROUNDS FOR CANCELLATION OF BOOKINGS BY THE CUSTOMER 

7.1. Legitimate grounds for cancellation by the Customer: The Customer, expressly stating the reason and assuming the corresponding cancellation costs and supplier conditions, may only cancel a booking made through the platform under the following circumstances and always with a minimum of 72 hours’ notice prior to the provision of the service: 

(i) Change of event date; 
(ii) Event permanently cancelled; 
(iii) Personal or family reasons (illness, death, etc.) up to the fourth degree of consanguinity or third degree of affinity; 
(iv) Reduced budget or financial difficulties; 
(v) Adverse weather conditions in the case of outdoor events; 
(vi) Disagreement with the Provider prior to the event; 
(vii) Logistical problems; 
(viii) Better offer found outside the platform; 
(ix) Force Majeure (emergencies, mobility restrictions decreed by the government, etc.); 
(x) The minimum number of attendees for the event was not reached. 

7.2. Penalties: Cancellations made by the Customer may lead to the application of penalties as set out in the “Terms and Conditions” section. 

 

CLAIMS SUBMITTED BY THE CUSTOMER 

8.1. The Customer must handle any complaint or claim made against the Provider independently, with full indemnity for EVENTSTUR60.com and without requesting the involvement of EVENTSTUR, which assumes no responsibility and is exempt from any liability regarding such complaints or claims. However, in such cases, EVENTSTUR may, at its sole discretion: 
(i) offer support services to the Customer; 
(ii) act as an intermediary between the Customer and the Provider; and 
(iii) provide the Customer, at the Provider’s expense, with compensation in the event of a material irregularity or complaint relating to the Provider, or offer an alternative service of equal or better quality in the event of failure or inability to provide the service. 

8.2. In the event of claims by the Customer against the Provider (for example, if the service was rendered defectively or only partially), EVENTSTUR will manage the incident between both parties, such that: 
(i) if the Provider does not accept responsibility, it will inform the Customer and, if applicable, may carry out any commercial actions it deems appropriate with both parties in order to maintain the quality of its service, or may simply inform the Customer so that they may take whatever actions they deem necessary, with total indemnity for EVENTSTUR; 
(ii) if the Provider accepts responsibility, the amount of compensation claimed by the Customer or agreed upon by the parties may be processed through the platform within a maximum of 14 days from the acceptance of responsibility. 

In both cases, EVENTSTUR will continue to be entitled to receive the commission for its mediation in the booking. 

8.3. Any type of claim must be submitted through the platform within a maximum period of 15 days from the moment the incident giving rise to the claim occurs. The platform includes a section called “Claim” where a claim “ticket” is opened, containing a description of the facts leading to the complaint, and this is notified to the relevant party (customer or provider). 

8.4. EVENTSTUR’s involvement in the management and processing of Customer claims and/or complaints is limited to providing a communication channel between the parties. The platform is exempt from any liability arising from the incident in question. 

 

METHOD AND SYSTEMS OF PAYMENT BY THE CUSTOMER TO THE PROVIDER 

9.1. Payment for services provided by the Provider to the Customer may be made through various methods depending on the selected payment type and applicable cancellation policies. These variations will be specified by each Provider and will be visible to Customers via the PLATFORM. 

9.2. PAYMENT TO EVENTSTUR through the EVENTSTUR platform, by bank transfer or credit card at the time of making the reservation and/or providing the service. Payments made through the platform will be automatically charged from the provider’s account on the due payment date. 
The client will make the corresponding payment through the EVENTSTUR platform, which will act as an intermediary in the collection process. 
EVENTSTUR will retain a commission on the total amount of the reservation, as established in these terms, and will transfer the remaining amount to the provider (generally 85%). In any case, the provider is responsible for the commercial relationship with the client, including the management and claim of any unpaid amounts. If the client does not make the payment, it will be the provider who must claim directly from the client, without EVENTSTUR assuming any responsibility for such claim or its outcome. The provider’s obligation to pay the commission to EVENTSTUR is independent of the client’s actual payment. Therefore, even if the client does not pay or there is a default, the provider is obliged to pay the commission corresponding to EVENTSTUR. If the provider does not pay the commission within the established deadlines, EVENTSTUR may apply the corresponding measures, including blocking the provider’s account and taking legal action to collect the amounts owed. 

In case of cancellation of the reservation by the Client: 

(i) If no payments have been made yet and there is no cancellation cost, the reservation will be canceled without economic consequences for the Client. 

(ii) If no payments have been made yet, but there is a cancellation cost or fee, the amount will be charged to the client. 

(iii) If payments have already been made, they will be refunded according to the cancellation policies.  

9.3. PAYMENT TO THE PROVIDER: can be made through the platform, on-site at the event (by card or in cash), or through a combination of both methods. 

  1. I) If payment is made entirely through the platform, it will be processed via bank transfer or credit card. Payments will be automatically charged to the Provider’s account on the scheduled In case of cancellation:
    (i) If no payments have yet been made and there is no cancellation fee, the booking will be cancelled without financial consequences for the Customer.
    (ii) If no payments have yet been made, but a cancellation fee applies, the amount will be charged to the Customer. 
    (iii) If payments have already been made, they will be refunded according to the applicable cancellation policies. 
  2. II) If payment is made entirely on-site, by credit card or in cash:
    (ii) If payment is made exclusively by card, within the “My Events” section under the specific event and booking reference, a section will be created with a QR code and a “payment link” that will verify the payment. This system allows partial payments from multiple participants until the full amount is reached. In case of any extras, the Provider will include them under the “other services included” section, with a request for Customer approval.
    (iii) If payment is made exclusively in cash, a field will be created on the platform where the Customer will enter the amount paid and another field where the Provider will enter the amount received. 
    (iv) If payment is split between cash and card on the event day, each payment method will be applied accordingly (g., a group dinner with some paying in cash and others by card). 

In the event of a confirmed booking where full or partial payment is scheduled for the event day and the booking is cancelled with applicable fees, the cancellation fee will be automatically charged to the Customer’s card—even if the payment was to be made in cash—because it will no longer be considered “on the event day.” Therefore, cancellation fees (if applicable) will always be charged via the platform using a card provided by the Customer, regardless of whether the final payment is in cash or card at the event location. 

III) If using a combination of both methods: part through the platform, part at the event (in cash or card): 
(i) If a partial prepayment was made via card, upon service delivery, the Provider will show the Customer the amount already paid to confirm the remaining balance to be paid on-site via card or cash. 

Cancellation fees (if applicable) will be charged through the platform using a card provided by the Customer, regardless of whether final payment is made on-site in cash or by card. 

9.4. Credit Card Payments to the Provider: The Provider must accept all major credit cards (such as MasterCard, Visa, and American Express) to guarantee a booking. The Provider is responsible for verifying the card data, pre-authorizing the card, and confirming that the credit limit covers the reserved service. The Provider must carry out this verification and pre-authorization without delay upon receiving the booking. The Provider assumes all risks arising from the possible invalidity or ineffectiveness of the credit card for any reason. 

The Provider is responsible for charging the Customer for the provided service, no-show fees, and/or cancellation charges, including applicable taxes. When processing payment card information in relation to this Agreement, the Provider and its service providers must always comply with the current Payment Card Industry Data Security Standard (PCI DSS) requirements, validation procedures, and compliance criteria issued by major credit card companies. 

If services are offered that can only be paid in cash, EVENTSTUR will not provide the Provider with credit card details as a guarantee for the booking. 

SETTLEMENT AND INVOICING OF TRANSACTIONS BETWEEN EVENTSTUR360.COM AND THE PROVIDER 

10.1. In the event that the Client has verified payment for the Provider’s service through the platform, EVENTSTUR will proceed with settlement within 7 days from the next business day following the provision of the service, after deducting the corresponding commission and issuing the relevant invoice. Payments through the platform will be automatically debited or credited to the Provider’s account on the respective payment day. 

If any claim, modification, or error arises, it will be resolved within a maximum period of 30 days. 

10.2. In the event that the Client has verified payment for the service directly to the Provider, EVENTSTUR will invoice its commission to the Provider within 7, 15, or 30 days from the next business day following the provision of the service, by issuing the corresponding invoice. 

The Provider may change the payment date in the extranet, and the change will apply to subsequent transactions. This amount will be invoiced and automatically debited from the Provider’s account “as if it were a subscription fee,” with prior notification by EVENTSTUR through the Stripe system. In the event of non-payment due to insufficient funds or any other reason, the Provider must proceed with the payment immediately and always within 14 days of the invoice date via bank transfer. The Provider shall bear all bank fees incurred due to the non-payment. 

In case of delay in payment of invoices issued by EVENTSTUR to the Provider, EVENTSTUR may claim the applicable statutory interest for late payment in commercial transactions and/or, if necessary, suspend the Provider’s presence on the platform until the outstanding amount is resolved. 

If the Provider is subject to any deductions or withholdings, they must pay EVENTSTUR the additional amounts necessary to ensure that EVENTSTUR receives the full (net) amount specified in the invoice, as it would have without any such deductions. The Provider is responsible for the payment of any taxes and/or withholdings on the total (net) amount of the commission. 

The Provider is responsible for withholding and reporting any taxes related to the Commission, in accordance with applicable tax laws and regulations. The Provider shall bear and be liable for the payment of any taxes applicable to the Commission and for any liabilities that may arise from delays or failures in tax settlements, holding EVENTSTUR harmless from any consequences. Upon request by EVENTSTUR, the Provider shall submit copies of tax payment certificates and/or tax exemption certificates after each Commission payment. 

 

USE OF DATA AND EVENTSTUR ONLINE SERVICES 

11.1. The Parties agree to adhere to Annexes 1 (Data Privacy Guidelines) and 2 (Data Security and Breach) regarding the processing of Confidential Data and Personal Data related to the provision of the services. 

11.2. Without prejudice to any contrary provisions in this document, the Provider agrees to comply, and to ensure that any person acting on their behalf complies, with the Terms of Use of EVENTSTUR’s commercial partner account, available on the Platform. 

 

MESSAGING SERVICE 

12.1. As part of its service to the User and the Provider, EVENTSTUR may occasionally facilitate communication between the Client, the Provider, and EVENTSTUR (the “Messaging Service”). EVENTSTUR may process (including storage, receipt, access, information, and monitoring) communications sent through the Messaging Service (“Communications”) in order to provide the service to the Client and the Provider. 

12.2. The Provider understands and agrees that EVENTSTUR will process (including storage, receipt, access, information, and monitoring) the Communications and guarantees that it has informed (and, where required by applicable law, obtained all necessary consents from) its employees, agents, representatives, staff members, and other individuals before using the Messaging Service on behalf of the Provider. 

12.3. The Provider will not use the Messaging Service to send unsolicited electronic communications to any person and fully indemnifies EVENTSTUR from any third-party claims, fines, or penalties resulting from the unlawful or unauthorized use of the Messaging Service by the Provider. 

 

LICENSE AND DATA 

13.1. The Provider grants EVENTSTUR a non-exclusive, worldwide, royalty-free license (or sublicense, as applicable) to: 

(i) use, reproduce, have reproduced, distribute, sublicense, communicate, make available by any means, and display the intellectual property related to its products and services provided to EVENTSTUR under this Agreement, to the extent necessary for EVENTSTUR to exercise its rights and perform its obligations under this Agreement; and 

(ii) use, reproduce, have reproduced, process, distribute, sublicense, display, and utilize (including, without limitation, publicly use, modify, adapt, communicate, reproduce, copy, and make publicly available in any form) the information regarding the Provider’s products and services. 

13.2. EVENTSTUR may sublicense, make available, disclose, and offer through or in collaboration with an Affiliate and/or third-party platform: 

(i) information about the Provider’s products and services; 

(ii) the Provider’s relevant intellectual property; 

(iii) the Provider’s primary contact data; 

(iv) special offers made available by the Provider on the Platform; and 

(v) any additional rights and licenses set forth in the Agreement. 

EVENTSTUR will not be held liable to the Provider for any act or omission by any third-party platform. 

13.3. EVENTSTUR may display some or all Platform content on third-party websites and platforms. Where EVENTSTUR’s sharing of Clients’ Personal Data or other Provider-related data with third parties is not essential for the Platform’s operation, the Provider may: 

(i) where applicable, modify its data-sharing preferences through the opt-out mechanism available in the account settings; or, if no opt-out mechanism is available, 

(ii) contact EVENTSTUR at “Contact with Eventstur” – user attention as required under applicable data and technology law, that such data-sharing preferences be adjusted. 

13.4. The data EVENTSTUR collects in relation to the Provider (including its staff, agents, representatives, and others), or which is generated through the Provider’s use of the Platform, depends on the context of the business relationship and interaction with EVENTSTUR, the choices made, and the products, services, and features used. This data may include: 

(i) Personal data, contact data, financial data, collaborator service data, and collaborator marketing data; and 

(ii) verification data, insolvency case information, fraud detection data, law enforcement and tax authority requests, and product usage data and analytics. 

The Provider can access the data listed in 13.4 (i) via the Extranet. 

13.5. The data EVENTSTUR collects in relation to Clients depends on the context of their interaction with EVENTSTUR, their choices, and the products, services, and features used. Such data may include, but is not limited to, booking data, payment data, account data, Customer Service data, feedback, marketing preferences, and product usage and analytics data. The Provider may access this data (when necessary and, in the case of usage and analytics data, in aggregated form) through the Extranet. 

13.6. EVENTSTUR has access to User and Provider data for purposes including, but not limited to: 

(i) delivering services (including making, managing, and processing bookings and handling payments); 

(ii) providing Customer Service support; 

(iii) detecting, preventing, and investigating fraud, illegal activity, and data breaches; 

(iv) analyzing and improving the product; 

(v) marketing and service updates; 

(vi) delivering products and services via servers, technical support, and general maintenance, as well as ensuring the security of shared data; and 

(vii) ensuring compliance with applicable law. 

13.7. Information on how EVENTSTUR collects, uses, shares, or processes Personal Data is outlined in the Platform’s privacy policies, which are updated periodically. 

CLIENT RANKING AND REVIEWS 

14.1. Ranking: 

The purpose of the EVENTSTUR platform is to display relevant search results for each specific Client. To achieve this, the Platform offers a default and personalized ranking of Providers, products, and services. 

Since EVENTSTUR will not initially have sufficient data to determine the appropriate criteria for search result rankings, it has decided to implement a random system. 

This system ensures that each time a user performs a search, a different Provider appears, thereby giving all Providers an equal chance to appear at the top of search results. Based on those initial searches, a ranking will be generated using the following parameters: 

Positive ranking factors: 

(i) Fields completed by the Provider in their EVENTSTUR profile (the more detailed the offer, the higher the likelihood of appearing first in searches); 
(ii) Clicks on your service/subcategory; 
(iii) Bookings within the completed subcategory; 
(iv) Ratings from clients or other providers, both in quantity and quality; 
(v) Posts in the “My Profile” section of EVENTSTUR; 
(vi) Number of times the Provider’s profile has been searched. 

Negative ranking factors: 

(i) Unjustified booking cancellations; 
(ii) Negative ratings (1–2 stars); 
(iii) Number of complaints (from both clients and other collaborating providers) that are accepted (lower penalty) and/or not accepted (higher penalty). 

 

14.2. Client Reviews 

EVENTSTUR will ask Clients who have purchased products and/or services to review their experience and provide a rating on specific aspects. EVENTSTUR may publish these reviews on the Platform. EVENTSTUR acts as a distributor, not a publisher, of these reviews. It will evaluate Client Reviews in accordance with the applicable Policies. EVENTSTUR will not be held liable for the presence or absence of Client Reviews on the Platform, in accordance with applicable laws. 

At its sole discretion, EVENTSTUR may block, remove, or request that a Client provide a modified version of a review if it includes or references any content that EVENTSTUR reasonably deems inappropriate or offensive, including but not limited to: 

(i) politically sensitive content; 
(ii) illegal activities; 
(iii) personal or sensitive information (e.g., emails, addresses, phone numbers, or credit card data); 
(iv) other websites; 
(v) profanity, sexual references, hate speech, discriminatory comments, threats, insults, or references to violence. 

The Provider shall not manipulate or attempt to manipulate Client Reviews, directly or indirectly (e.g., by paying for positive reviews or posting fake reviews about competitors). Any breach of this Clause shall be grounds for termination of the contract. 

Client Reviews are for the exclusive use of EVENTSTUR. The Provider shall not use Client Reviews directly or indirectly in any manner without EVENTSTUR’s prior written consent. 

 

14.3. (Online) Marketing and Advertising 

EVENTSTUR carries out online marketing campaigns at its own expense and discretion and may promote the Provider using the name of its products and/or services in such marketing, including email campaigns and pay-per-click advertising. 

The Provider acknowledges how search engine systems work (e.g., content crawling and URL ranking). 

The Provider agrees not to use, directly or indirectly, EVENTSTUR’s brand/logo (including trade name, trademark, service mark, or any other similar indicator of identity or source) for price comparison or any other purpose, whether on the Provider’s own platform or on any third-party platform, system, or search engine, unless EVENTSTUR has given prior written approval. The Provider shall not use or create, directly or indirectly, any pay-per-click advertising on (meta)search sites that (re)direct to the Provider’s landing page on the Platform where their products and services are listed or promoted. The Provider may submit an offer or use the EVENTSTUR brand for their own digital marketing and pay-per-click advertising. 

 

OTHER TOOLS FOR PROVIDERS AND USERS 

15.1. Planner 5D Layout System: 
Subject to acceptance of its specific terms and conditions, both Users and registered Providers on EVENTSTUR will have the option to create an account on the external application Planner 5D under the following particular conditions: 

(i) Unlimited users and projects with a limit of 300 furniture items (after 300 items, €10 per additional item, with technology to add variations and textures); 
(ii) Obligation to create an account on Planner 5D and accept its terms in order to manage personal libraries and modify/add customization variants; 
(iii) Web platform integrated via iFrame; 
(iv) Applications available on the Apple, Google, and Microsoft stores; 
(v) The “eventsut” Library will consist of folders containing furniture items for each furniture company subcategory (indicating their price and rental availability), and folders with furniture from venues that have partnered with EVENTSTUR (these items will not have prices or rental options, as they are included with the venue). 

For furniture Providers exclusively, the EVENTSTUR library will include the following features: 

(i) For each furniture provider subcategory, there will be a folder with subfolders (organized by furniture category). 

EVENTSTUR will provide Providers, through the website, with precise and necessary instructions to upload and register furniture items to the appropriate libraries. 

EVENTSTUR will also provide Clients, through the website, with detailed and necessary instructions to access the corresponding Libraries according to their profile, offering: 

(i) A free-access application with limited functionality; 
(ii) A paid application called “Planner 5D Partner,” which, for €33/month plus VAT (including a 25% commission for EVENTSTUR), provides a link in the “My Creations” section that allows users to upload 3D furniture, move items, etc. 

 

15.2. For Venue Providers, they will have access to the Trellis application, which allows the generation of 3D images from furniture photos, which can then be uploaded to Planner 5D. 

 

15.3. “Canva Panel”: 
This is a space where users can add elements, images, and/or logos to make a request to the Provider, or where the Provider can create a design for the client. 

REPRESENTATIONS AND WARRANTIES 

16.1. The Provider represents and warrants to EVENTSTUR that, during the term of this Agreement: 

(i) The Provider has all necessary rights, powers, and authority to use, operate, own (as applicable), license, and sublicense, and to allow EVENTSTUR to publish on the Platform its products and services and all intellectual property related to the Provider, as detailed or referenced in the Provider Information; 

(ii) The Provider holds and complies with all required permits, licenses, authorizations, registrations, and administrative requirements (including the obligation to share mandatory information with authorities) necessary to carry out its business activities and to make its products and services available for booking on the Platform; 

(iii) The Provider is duly registered with all applicable tax authorities (including tax collection agencies) as a business engaged in selling the products and/or providing the services it offers through the Platform; 

(iv) Neither the Provider nor its directors and beneficial owners — whether direct, indirect, or ultimate — nor its officers, nor any third parties working for or on behalf of the Provider, are: 

(a) in any way connected with terrorists or terrorist organizations; 
(b) included on any applicable list of sanctioned or restricted entities or individuals; or 
(c) ordinarily resident in, or organized under the laws of, any jurisdiction subject to comprehensive or territorial sanctions, 
with which doing business is prohibited under applicable laws. 

16.2. The Provider will not undertake any actions that violate or place EVENTSTUR in violation of applicable sanctions. In the case of an actual or suspected breach of this Clause 5.1 (vi), the Provider shall immediately notify EVENTSTUR; and 

(v) The Provider: 

(a) respects the human rights of its staff and clients, and does not employ child labor, forced labor, or maintain unsafe working conditions; 
(b) does not engage in or permit discrimination based on race, religion, disability, or gender, nor allow cruel or abusive practices within its facilities; 
(c) pays each employee at least the applicable minimum wage, provides all legally required benefits, and complies with applicable labor laws, working hours, and employment rights in the jurisdiction in which the Provider operates; and 
(d) will not subject any individual to slavery or servitude, nor organize or facilitate travel or accommodation for the purpose of exploitation. 

16.3. The Provider will encourage any supplier of goods or services it uses to fulfill its obligations under this Agreement to comply with the standards set out in this Clause. 

16.4. Each Party represents and warrants to the other Party that, during the term of the Agreement: 

(i) it has full power and authority to enter into the Agreement and fulfill its obligations under it; 
(ii) it has taken all required corporate actions to authorize the execution and performance of the Agreement; 
(iii) it complies with all applicable laws, regulations, ordinances, and rules in the country, state, or municipality under which each Party is organized with respect to the products and/or services offered or provided by each Party. 

16.5. EVENTSTUR disclaims and excludes all liability related to the Provider regarding: 

(i) any (temporary and/or partial) malfunction, outages, downtime, interruptions, or unavailability of the Platform, the Service, and/or the Extranet; and 
(ii) any (connection to any) connectivity provider or connectivity services the Provider uses to transmit the information regarding its products or services. 

16.6. EVENTSTUR will provide the Service, the Platform, and the Extranet “as is” and “as available,” and the Provider accepts them on these terms. EVENTSTUR may make changes to the Service, Platform, and Extranet at any time. 

INDEMNIFICATION AND LIABILITY 

17.1 Mutual Indemnifications 

17.1.1 Each Party shall be responsible for and shall compensate, indemnify, and hold harmless the other Party and its Affiliates, directors, officers, employees, agents, representatives, and subcontractors from and against any direct damages, losses, debts, obligations, costs, claims of any kind, interests, fines, administrative charges, legal costs, and expenses (including, but not limited to, reasonable attorneys’ fees and expenses) paid, suffered, or incurred in connection with: 

(i) a breach of this Agreement by the other Party; 

(ii) gross negligence and willful misconduct; and 

(iii) any third-party claim based on the (alleged) infringement of such third party’s intellectual property rights by the other Party. 

17.1.2 Each Party is obliged to take appropriate measures to prevent and mitigate potential damages. 

17.1.3 Each Party shall notify the other Party as soon as possible after becoming aware of any third-party claim. In the event of any third-party claim (including all civil, criminal, administrative, or investigative actions, claims, proceedings, lawsuits, charges, causes of action, or other proceedings involving losses against a Party brought by a third party), the Parties shall act in good faith and use commercially reasonable efforts to consult, cooperate, and assist each other in defending and/or settling the claim. 

 

17.2 Indemnifications by the Provider 

17.2.1 The Provider shall indemnify, compensate, and hold harmless EVENTSTUR and its Affiliates, directors, officers, employees, agents, representatives, and subcontractors from and against any direct damages, losses, debts, obligations, costs, claims of any kind, interests, fines, administrative charges, legal costs, and expenses (including, but not limited to, reasonable attorneys’ fees and expenses) related to: 

(i) all claims made by Clients regarding inaccurate, erroneous, or misleading Provider Information; 

(ii) all claims from Clients related to the Provider’s products and/or services marketed through the EVENTSTUR S.L. platform, including full or partial cancellation of bookings, booking errors, refunds, or chargebacks of service fees; 

(iii) all other Client claims wholly or partly attributable to the Provider (including its directors, employees, agents, subcontractors, representatives, and premises); 

(iv) all claims, including costs, expenses, interests, fines, and other liabilities against, presented, or incurred by EVENTSTUR in connection with or as a result of: 

(a) the Provider’s breaches related to any administration, including tax matters; 

(b) tax claims against EVENTSTUR and liabilities for taxes for which the Provider is responsible, or where the obligation to pay, collect, withhold, and remit falls by law on EVENTSTUR on behalf or instead of the Provider; 

(v) all claims and investigations brought by third parties and authorities related to the Provider’s obligations, warranties, and representations under the Agreement; 

(vi) all claims or complaints regarding EVENTSTUR’s non-compliance with applicable laws to the extent such non-compliance is wholly or partly attributable to the Provider (in which case the Provider agrees to pay the appropriate proportion of damages or fines related to EVENTSTUR). 

TERM, TERMINATION, AND SUSPENSION 

18.1 Unless otherwise agreed, this Agreement shall enter into force on the date of acceptance by the Provider and shall continue for an indefinite period. The Provider may terminate this Agreement at any time and for any reason by providing EVENTSTUR with written notice with a 15-day notice period. 

18.2 EVENTSTUR may, by written notice (including a statement of reasons), terminate, restrict, or suspend all or part of its obligations, covenants, and commitments under this Agreement with immediate effect, and/or may terminate the Agreement and/or close its Platform for the Provider in the event of any of the following causes or circumstances (reasonably anticipated or suspected): 

(i) any breach by the Provider of any condition of the Agreement and/or these general conditions; 

(ii) the filing of a bankruptcy petition or similar event regarding the Provider; 

(iii) non-payment of any invoice, debit note, or outstanding charges owed to EVENTSTUR on the due date; 

(iv) bad faith attempts to avoid or reduce the payment of a Commission; 

(v) delivery of inaccurate, outdated, incomplete, confusing, or fraudulent information by the Provider, including publication of such product and/or service information on the Extranet or through a connectivity Provider; 

(vi) refusal to accept a reservation at the price and/or conditions shown in the booking or failure to comply with the agreed price and/or reservation conditions; 

(vii) charging the Client more than agreed by the Provider; 

(viii) misuse by the Provider of a Client’s credit card data or other Client data (e.g., charging a Client’s credit card before check-in without prior Client consent), or if a data breach occurs; 

(ix) serious complaints from one or more Clients or a third party; 

(x) consistently unsatisfactory scores or comments; 

(xi) direct or indirect manipulation or attempted manipulation by the Provider of a reservation or the Platform’s operation (e.g., manipulating Client Reviews); 

(xii) any safety, privacy, or health issue in the Provider’s products, services, or premises (the Provider shall, at its own expense and upon EVENTSTUR’s request, provide permits, licenses, certificates, and statements issued by an independent expert to demonstrate and support compliance with applicable laws and regulations regarding hygiene, safety, and privacy); 

(xiii) if the Provider terminates a contract with any EVENTSTUR Affiliate without showing cause and/or for convenience; 

(xiv) breach, including any act or cause of breach or inability to perform any obligation, of any other agreement between the Provider and EVENTSTUR or any EVENTSTUR Affiliate; 

(xv) any conduct by the Provider incompatible with EVENTSTUR’s overall business model, technology, or policies; 

(xvi) reasonable belief by EVENTSTUR that measures are necessary to protect the personal safety or services of EVENTSTUR, Clients, or third parties, and to prevent inappropriate, illegal, or unprofessional conduct, whether physical or otherwise, and/or acts of bad faith, fraud, or other unacceptable activities; 

(xvii) reasonable belief by EVENTSTUR that the Provider breaches any of its representations in Clauses 5.1 (v), 5.1 (vi), 5.2 (iv), 11.5, and 11.6, or its obligations set forth in Clauses 11.1 to 11.4; or 

(xviii) failure by the Provider to provide (in a timely manner) to EVENTSTUR information, documents, or other evidence that are accurate, complete, and up-to-date and that EVENTSTUR may reasonably request periodically in relation to its due diligence processes or to ensure EVENTSTUR complies with applicable laws or other requirements. 

(xix) failure to use the Platform by the Provider continuously for more than one year. 

18.3 Any notice or communication of “closure” (or equivalent terminology) of the Provider’s participation on the website by EVENTSTUR shall be understood as termination of this Agreement. After termination or suspension of the Agreement, the Provider shall honor all pending bookings for Clients and shall pay all pending Commissions (in addition to costs, expenses, and interest if applicable) related to such bookings in accordance with the terms of this Agreement. Upon termination or suspension of the Agreement, and without prejudice to EVENTSTUR’s right to permanently remove the Provider, its products, and services from the Platform, EVENTSTUR may keep the Provider’s page on the Platform but may close availability (status “operations closed”) pending full and final payment of all amounts due and outstanding (including any Commissions). 

18.4 Upon termination of the Agreement, the rights and remedies of each Party regarding indemnification or breach by the other Party shall survive. Clauses 2.3, 6, 7.6, and 8 to 12 (and any other Clause intended by its nature to survive termination) shall remain in effect after termination. 

18.5 In the event of a change of ownership or operator of the Provider, including any assignment, transfer, or novation of the Agreement, the Provider agrees that the new owner or operator may use the Provider Information, including Client Reviews, that was available or used by the Provider prior to the change of ownership, and shall have access to relevant (Client), management, and performance data (financial and operational). In any case, the Provider shall remain responsible for all obligations, claims, and liabilities relating to or accrued during the period prior to the change of ownership or operator. 

BOOKS AND RECORDS 

19.1 The systems, books, and records of EVENTSTUR (including its financial systems, the Extranet, the online Booking Report, faxes, and emails) shall be considered conclusive evidence of the existence and receipt by the Provider of the bookings made and of the Commissions, damages, and costs owed to EVENTSTUR under this Agreement, unless the Provider can provide sufficient and credible evidence to the contrary. 

19.2 The Provider shall fully cooperate and provide EVENTSTUR with all information reasonably requested regarding the identification of the owner (ultimate beneficial owner), manager, and/or controller of the Provider, as well as the Provider’s risk profile. Unless otherwise specified in EVENTSTUR’s request, such information shall be provided within fifteen days of EVENTSTUR’s request. 

19.3 EVENTSTUR may conduct and/or instruct a third party to conduct an inspection or audit of the Provider’s records (including information related to data processing or security information) to the extent reasonably necessary to comply with EVENTSTUR’s legal or reporting obligations, and when EVENTSTUR reasonably suspects a breach of the Agreement by the Provider. The Provider and its employees, agents, and representatives shall fully cooperate with EVENTSTUR and such third party, providing access to all books, records, premises, personnel, and other relevant information, and shall facilitate copies as necessary. 

19.4 EVENTSTUR shall bear the costs of any inspection or audit unless it reveals a breach by the Provider of any provision of the Agreement, in which case the costs shall be borne by the Provider without prejudice to EVENTSTUR’s additional rights and remedies regarding the breach. 

EXCHANGE OF INFORMATION AND CONFIDENTIALITY 

20.1 The Parties understand and agree that, in connection with the execution of the Agreement, each of them may access or be exposed, directly or indirectly, to confidential information of the other Party (the “Confidential Information”). Confidential Information includes Customer or User Data, Personal Data, transaction volume, marketing and business plans, business, financial, technical, operational information, and other non-public information that the Disclosing Party designates as private or confidential or that a Receiving Party should reasonably know to be handled as private and confidential. 

20.2 Each Party agrees that, unless otherwise stipulated in this Clause: 

(i) all Confidential Information shall remain the exclusive property of the Disclosing Party. The Receiving Party shall not use the Confidential Information for any purpose other than to fulfill its obligations under the Agreement; 

(ii) it will maintain and use prudent methods to ensure that employees, executives, representatives, contracting parties, and agents (the “Authorized Persons”) maintain the security of the Confidential Information; 

(iii) it will disclose Confidential Information to Authorized Persons only to the extent necessary to fulfill its obligations under the Agreement; 

(iv) it will use prudent methods to ensure that Authorized Persons do not copy, publish, disclose to others, or use (other than as permitted under the Agreement) the Confidential Information; and 

(v) it will return or destroy all copies, in printed or electronic format, of the Confidential Information upon request by the other Party. 

20.3 Notwithstanding the above, Confidential Information shall not include any information to the extent that: 

(i) it is or becomes public knowledge or is available by means other than an act or omission of the Receiving Party; 

(ii) it was in the possession of the Receiving Party prior to the date of the Agreement; 

(iii) it has been disclosed to the Receiving Party by third parties who have no confidentiality obligations regarding the Confidential Information; or 

(iv) it must be disclosed by law, court order, subpoena, or governmental authority. 

20.4 Without prejudice to the foregoing, EVENTSTUR may disclose any information related to the Provider and/or the Agreement to EVENTSTUR’s affiliated companies. Such information may include, but is not limited to, Confidential Information and information about the Provider’s performance and compliance with the Policies under this Agreement. EVENTSTUR shall ensure that all EVENTSTUR affiliated companies receiving Confidential Information are subject to the same confidentiality obligations as it is. 

 

  1. DISPUTE RESOLUTION

21.1 Applicable Law and Jurisdiction 

21.1.1 The execution and interpretation of this Agreement shall be governed exclusively by Spanish law. Provided that submission is not mandatory and jurisdiction belongs to another court, any dispute arising out of or relating to this Agreement shall be brought before the Courts and Tribunals of the city of Barcelona, with the Parties waiving any other jurisdiction that may correspond to them by reason of their domicile. 

21.2 Complaint Management System between the Parties 

21.2.1 EVENTSTUR offers a complaint management system to resolve conflicts with the Provider. The Provider may submit a complaint through the complaint resolution center or by contacting their exclusive account representative (if applicable). The complaint resolution center is accessible via EVENTSTUR Queries and the EVENTSTUR Platform, including through the EVENTSTUR chatbot. 

21.2.2 EVENTSTUR will acknowledge receipt of the complaint and provide additional information about the complaint management process via the Extranet or by email. 

21.2.3 To the extent permitted by law and third-party confidentiality rights, EVENTSTUR will provide periodic updates on the progress of the complaint management. If necessary, EVENTSTUR will contact the Provider to request further information and assess the possibility of resolving the issue. The Provider may withdraw their complaint at any time. EVENTSTUR will provide the Provider with a resolution or updated information on the complaint management process within 5 days from the date the complaint was submitted. 

 

  1. MISCELLANEOUS PROVISIONS

22.1 Neither Party may assign, transfer, and/or encumber any of its rights and/or obligations under the Agreement (except to an EVENTSTUR affiliated company) without the prior written consent of the other Party. No assignment, novation, or transfer by the Provider shall release it from its obligations under the Agreement. 

22.2 All notices and communications must be in Catalan, Spanish, or English. They must be in writing and sent via the Extranet inbox, fax, email, or nationally recognized overnight courier using the contact details each Party timely provides. 

22.3 In case of conflict between the terms of the contract signed by EVENTSTUR and the Provider and the terms of these General Conditions and/or their Annexes, the Contract shall prevail. 

22.4 If any provision of these General Conditions and/or their Annexes is or is declared invalid or unenforceable, the Parties shall remain bound by all other provisions and shall replace the invalid or unenforceable provision with valid and enforceable provisions having the closest possible effect to the original agreement. 

22.5 The original Spanish version of these conditions has been translated into other languages. In case of discrepancy between the version in other languages and the Spanish version of the conditions, the Spanish version shall prevail. The Spanish version shall be used in legal proceedings, such as for the complaint mechanism and mediation. 22.6 The Contract between the Parties may be executed online or by means of printed or PDF counterparts, each of which shall be considered an original and be valid and binding. By registering and joining the EVENTSTUR collaborators program, the Provider accepts and agrees to comply with the terms and conditions of the Agreement. The Agreement does not require any seal to be valid, binding, and enforceable. 

22.7 The Provider agrees to fully compensate and indemnify EVENTSTUR for any damage, loss, claim, penalty, fine, costs, and expenses paid or incurred by EVENTSTUR (or any of its affiliated companies, directors, officers, employees, agents, representatives, and subcontractors) arising from any (pending or potential) claim or sanction from any government, authority, organization, company, party, or person related to the illegality or non-compliance of the Requirements relating to financial crimes of payments received or made through the Bank Account. 

22.8 EVENTSTUR may timely update and amend the conditions, subject to prior notice to users and the Provider by email and/or publication on its website with a minimum notice period of 15 days. During the notice period, the Provider may terminate the Agreement if it so decides. Any updated or amended version shall replace and supersede the current version as of the date specified in the notice.

Extranet: The space where the provider can define their categories, subcategories, and offer for events. 

Clients: Natural or legal person registered on Eventstur to hire providers and organize their event. 

Individual: A natural person who hires providers and plans their event through Eventstur.

Furniture: Rental or sale items such as tables, chairs, tents, and other event items. 

Decoration: Rental or sale items such as lights, flowers, balloons, and other event items. 

Music: DJs or musicians for your event. 

Photography: Photographers, videographers, photo booths, or other photography-related services. 

Staff: Waiters, hosts/hostesses, security, cleaning staff for events. 

Activities, entertainment and shows: Fun or competitive services of various types like magic, paintball, karting, etc. 

Base price: The service price set by the provider in the catalog section, excluding transport fees, extra people, or other add-ons that may supplement the base price. 

Provider company: Natural or legal person registered on Eventstur whose account is tied to their NIF/DNI (Tax ID). 

Category: Venue, catering, furniture, decoration, music, photography, staff… 

Service/Subcategory: Within each category, there may be subcategories. For example, under the venue category, a company might manage multiple venues: Masia Vilasendra, Masia Sa Tuna, and Wolf—all under the same parent company. Another example: under music, a company may offer separate services for soloists, duos, and trios. 

Venue areas: In the case of venues, a subcategory can be divided into venue areas, which may be offered separately or as a unified space. For example: within the venue category, you may have Masia Vilasendra and Discoteca Wolf, and each can be rented by area or in full, with different base prices. 

General discount code: A discount applied by the parent company and applicable to the total of all categories booked by the client. 

Specific discount code: A discount that applies only to the relevant subcategory. 

Event-type-specific discount code: A discount that applies to a specific subcategory but only for a particular type of event. 

My account: Section where clients and providers manage company-wide details and data, and manage admins, managers, and operators. 

Admin: Physical person and main responsible party of the client or provider company, with full access to edit and assign permissions to managers and operators. 

Managers: Individuals assigned by the company admin with extended editing and interaction access on the portal. 

Operators: Individuals assigned by the company admin with extended editing and interaction access on the portal. 

Eventstur community or social network: The Eventstur portal screen where you can view events published by other users and the providers they worked with. 

My profile: Refers to the profile within Eventstur’s social network/community. Clients and providers can post their events and share them with other users. The profile may be linked to a service/subcategory or cover multiple services/subcategories. 

My events – clients: Space where clients can manage all aspects of their reservation: providers and services, guest management, budget, invoices, transactions and payments, checklist, running orders, and calendars… 

My events – provider: Space where providers manage all aspects of their reservation: view other providers and services, invoices, transactions and payments, checklist, running orders, and calendars… 

Transactions and payments: Section where both clients and providers can track payments, invoices, and refunds. 

My offer (provider): Section where the provider sets all the details of their services. 

Booked summary (client): A “unified invoice” type summary of all contracted providers and their respective payment and cancellation policies. 

Invoice summary: PDF document containing all invoices for each provider. This includes the “final” invoice, which is the valid one, and the previous versions with their respective refunds.

2. HOW WE OPERATE AT EVENTSTUR: 

  1. What is EventstuR360SL?

1.1 What we offer 

Find providers, plan, customize, and share: Your event in one portal. EVENTSTUR is a portal that allows clients (individuals, companies, and organizations) to register in a differentiated and free way to organize an event (wedding, birthday, meeting, party, etc.), facilitating access to multiple providers (venues, catering, furniture, decoration, DJs, photographers, etc.); planning tools (automation of timelines, calendars, guest management, budgeting, checklists…), depending on the type of event selected; and a high degree of customization (software to personalize invitations, furniture, space design in 2D and 3D with AI that speeds up the process and adds the furniture and decoration contracted to the venue. It also includes visualization and selection of pre-established menus by the catering provider, as well as a customizable menu system from catering companies… and much more). It allows booking and paying for services directly through the platform, knowing the price and availability of providers in real time. Simultaneously, the portal has a community (integrated social network), where clients and providers can publish the events they have held and tag the providers they have worked with, and see other users’ events to know how they have worked. All in the same portal. At the same time, it offers service provider companies the opportunity to register for free, benefiting from innovative technology and customization tools. In return, for each service booked by the client through the platform, EventstuR receives a commission of 10% or 15% on the provider’s sale (if you don’t sell anything, you don’t lose anything). These providers have differentiated registration depending on their category, although the same provider company can offer more than one category at the same time, allowing them to present their services in package format. They also have the option to differentiate their offer according to the type of event and to integrate collaborating companies they work with (collaboration contracts pre-established by EventstuR), thus offering a more competitive proposal and prices. 

1.2 Mission, vision, and values:

1.3 Who is it aimed at: clients, providers, and organizers 

1.3.1 Types of users: 

Individuals: Natural persons who want to organize a personal event (birthday, wedding, graduation, etc.). 

Companies: Natural persons (self-employed) or legal entities who wish to organize a corporate event (presentations, company dinners, product launches, team building, etc.). 

Entities: Public or private organizations (foundations, associations, administrations, etc.) that organize institutional, social, or community events. 

Providers: Natural persons (individuals or self-employed) or legal entities that offer products or services related to event celebrations (venues, catering, decoration, music, photography, etc.). 

Event organizers: Professionals or companies specialized in the planning, management, and execution of events, providing services on behalf of the client or under their own proposal. 

 

1.3.2 Client user: 

The platform distinguishes between two main types of client users according to their use of EventstuR: 

Individuals, companies, entities, and organizers who only seek specific providers: People who only need one or several specific services (such as DJ, venue, catering, etc.). 
Typical use: search by categories, price comparison, and direct contracting through the cart. 

Individuals, companies, entities, and organizers who organize complete events: People or entities who want to plan the entire event from a single place. 
Typical use: creation of events in “My Events,” automated management (budgets, checklists, guests), use of the Planner 5D, and coordination with various providers. 

1.3.3 Provider user: 

Providers with a commercial objective 
They use EventstuR mainly as a showcase and point of sale to attract clients, display their services, and manage bookings. Focused on visibility and direct conversion. 

Providers with a commercial and operational objective 
They integrate EventstuR into their daily operations, managing their agenda, budgets, contracts, and communication through the platform. They make full use of all available tools, using the portal as the core of their professional activity. 

 

1.4 Account types 

Each account on EventstuR, regardless of whether it is for a client, company, entity, or provider, is structured through different access codes and internal roles, allowing secure and personalized management of activity within the platform. 

Each user, upon registering, is classified as: 

Individual (only has a reference code) 
Company 
Entity 
Provider 

According to this classification, the following access levels are assigned: 

Reference code: Unique identifier of the main account. Determines whether it is an individual, company, entity, or provider. This code is essential for all internal management. 

Administrator code: Main user with full access to the account: can edit data, manage permissions, consult statistics, control payments, contract services, etc. Only one per account. 

Manager code(s): Users with broad permissions to organize events, manage providers, edit content, and view budgets. There can be several managers per account. 

Operator code(s): Users with limited access to specific tasks, such as attending requests, uploading information, or reviewing bookings. Intended for support staff or operational tasks. There can also be several. 

1.5 What types of events do we cover 

We are currently specialized in social and corporate events, with a progressive growth plan that includes the incorporation of cultural and sports events. Our strategic development contemplates the expansion of provider types, territorial expansion, and the continuous implementation of technological innovations and strategic alliances.

  1. How does the platform work?

2.1 User registration 

You can create your EventstuR account in two ways: 

  • Direct registration: by completing the form on our website. 
  • Registration with Google: linking your Google account for faster and more secure access. 

Upon completing registration, you will receive a verification email to activate your account and be able to log in. This activation link is valid for 72 hours, after which you will need to request a new one. 

2.2 Account creation 

With the registration on the portal, your account has already been created and you can fully enjoy all the benefits offered by the portal, except those that involve an additional cost, such as some specific Planner 5D functionalities. 

You will be able to browse the platform with a basic profile, but to book any service it will be mandatory to complete all the requested information more thoroughly in your account. This ensures that we have accurate and reliable data for managing your bookings and providing a personalized experience. 

Additionally, we implement a user validation system to increase security and trust on the platform: 

  • For individual clients and companies: DNI or NIF validation is required. 
  • For providers: they must validate both the DNI or NIF and submit the corresponding model 036. 

This process ensures the authenticity of all users and providers registered on EventstuR, allowing a reliable and professional environment for event organization. 

2.3 Profile creation 

Profile creation refers to your presence within the EventstuR social network. To do this, you will need to assign yourself an account number and actively manage it. You can create more than one profile within the same account. This profile can be public or private. You can check all the details and management options in section “2.16 Community.” 

2.4 Navigating the platform (clients) 

It is not necessary to log in to start browsing EventstuR. However, the moment you want to make a reservation or create an event, you will be asked to register. 

Before starting your search on EventstuR, you will need to indicate the type of event you want to organize. From there, you can explore all available providers, add their services to the cart, and manage each booking within that specific event. 

Each client will be able to see the provider including the following sections, which will be shown only according to the services and event selected, as well as with adjustable filters for dates, number of attendees, and other relevant criteria: 

  • Provider description: Information about their experience, philosophy, and specialization. 
  • Visual portfolio: Images and descriptions organized by subcategories (e.g., chairs, menus, equipment, etc.). 
  • Price list: Base prices, extras, transport, and additional conditions, with breakdowns including and excluding VAT. 
  • Service availability calendar, visits, menu tastings: For services or products with limited dates. It will show as “not available” if it cannot be booked. 
  • Specific selection and customization fields according to each provider: Menus, repertoires, item personalization, etc. 
  • Extra services 
  • Collaborating companies 
  • Exclusivities: Information about exclusive EventstuR services or provider’s own conditions. 
  • Reviews and ratings: Feedback from other users to help decision making. 
  • Contact and request for a quote or direct booking: Option to contact or send a personalized proposal from the platform. 
  • Payment methods and cancellation policies. 

2.5 Management from “My events” (client) 

When booking providers, they will automatically be added to the “My events” section, where from a single panel you can: 

  • View and manage all services and bookings of contracted, reserved, or pending providers. 
  • Manage modifications, claims, and reviews. 
  • Organize the event with tools such as: 
  • Automated schedule and calendar 
  • Centralized budget with invoices, contracted summary, and statistics 
  • Checklist 
  • Guest management 

You will also be able to share documents, articles, and logistical details with linked providers to maintain symmetrical information about the event. 

Access Planner 5D, a tool that allows you to: 

  • Design the space and layout in real time with an AI that lets you incorporate your furniture in seconds. 
  • Add furniture already reserved or available from the platform. 
  • Make reservations directly from the design. 

Planner 5D has three modes: a free one, a premium, and a one-time payment option. 

Free: You can self-design your space using our furniture library and the catalog of furniture and decoration companies registered on EventstuR. Available for both clients and providers. 

Premium (€33/month): 
Add your own furniture yourself using AI, whether from your space or from other external furniture and decoration companies outside EventstuR. 

One-time payment (cost according to quote and dimensions): 
EventstuR models your space or event with your own furniture and design. 

2.6 Intelligent Event Organizer (AI): Your Personal Planning Assistant 

To further simplify the complex task of organizing an event, EventstuR integrates an Intelligent Organizer powered by AI, designed to be your personal assistant from start to finish. 

  • Compatibility Analysis: When selecting multiple providers, the AI can offer a compatibility analysis between them (for example, ensuring that decoration styles and catering complement each other). 
  • Creation of Customized Timelines: Based on the type of event, date, and budget, our AI Organizer will generate a detailed timeline with key milestones and recommended deadlines for each task, from booking the venue to guest confirmation. 
  • Proactive Provider Suggestions: Based on your preferences, planning progress, and previous interactions, the AI Organizer will propose providers that perfectly fit your style, needs, and budget for each segment of your event. 
  • Automated Reminders and Notifications: You will receive timely reminders about pending tasks, upcoming payments, and necessary confirmations, ensuring you don’t miss anything. 
  • Dynamic Task Lists: The AI Organizer will generate and adjust personalized task lists as you progress in your planning, allowing you to mark completed items and add notes. 

EventstuR’s Intelligent Organizer (AI) transforms event planning from an overwhelming task into an organized, efficient, and above all, enjoyable experience, putting technology at the service of your celebrations. 

2.7 Community 

See the section later on “2.16 Community.” 

2.8 Reservations (clients): 

2.8.1 Reservation statuses: 

Confirmed reservation (direct reservation): If the Provider has direct booking enabled on the Platform, the reservation will be confirmed and paid (if applicable) with the corresponding cancellation policies. 

Reservation upon request (non-direct reservation): This procedure requires a second step by the Provider, consisting of accepting the reservation. Payment for the service will be made at the time of the request: 
(i) In case of acceptance, the payment will be confirmed; 
(ii) In case of rejection, the amount will be automatically refunded with express confirmation. 

24h reservation: It is possible to reserve and block the availability of a service on the platform for 24 hours, pending definitive reservation or contract. The same service may only be reserved and blocked 3 times within 1 month. 

Cart: Reserved services can be deposited in a personal cart, without this implying the blocking of the service availability (i.e., it can be contracted by other providers) and without the provider being informed. 

2.8.2 Modifications and management of reservations/services: 

See the section later “Modifications and management of reservations/services for clients and providers.” 

 

2.9 Payments (clients): 

Payment for services contracted through EventstuR can be made in different ways, depending on the type of provider, cancellation policies, and payment method. These conditions will be visible in each reservation. 

At EventstuR, payment for services can be made through various modalities, depending on the provider and the agreement established in each reservation. The available options are detailed below: 

2.9.1 Payment directly to EventstuR 

Through the portal: The client can pay the full or partial amount of the reservation through the portal: via bank transfer or credit card, either: 
– Upon confirming the reservation, or 
– At the time of service provision, according to the conditions established by the provider. 

In this case, EventstuR acts as the payment manager, but the provider remains the final responsible for the service provision and the correct management of associated payments. 

2.9.2 Payment directly to the provider 

Payment can be made in the following ways: 

Through the portal: 
Via bank transfer or credit card, either upon confirming the reservation or at the time of service provision. 

On-site, in person: 
– Payment by card: a payment link and a QR code will be enabled in the “My events” area, within the specific reservation, to facilitate payment collection. 
– Cash payment: both client and provider must manually register the amount effectively paid and received on the platform. 

It is possible to enable individual payments per attendee, allowing each participant to pay their share separately through the system. 

Combination of methods: 
In reservations with mixed payment (part through the portal and part at the event), the amount already paid via the platform will be shown and the rest managed at the event site, either by card or cash. 

Important: Even if payment is made on the event day in cash or card, any applicable cancellation cost will always be charged through the platform, using the card data provided by the client.

2.10 Types of available providers 

– Spaces: Rental of spaces for events, such as country houses, venues, rooms, nightclubs, hotels, etc. 
– Catering: Various options for gastronomic services, including services at establishments: restaurants, country houses, and other venues; full home services (including special services such as food trucks or popcorn and crepe stations); specific menus for events; and sale of products and items from their own establishment. 
– Furniture and Decoration: Rental or sale of furniture for events, decorative elements, invitations, personalized details, and gifts. 
– DJs and Live Music: Providers specialized in musical ambiance, such as DJs, live musicians, and sound technicians. 
– Photography and Video: Audiovisual services to capture the event, including photographers, videographers, photo booths, and special services. 
– Entertainment and Activities: Leisure proposals both on-site and at home, such as paintball, laser tag, escape rooms, improvisation shows, dance, magic, etc. 
– Staff: Hiring personnel for the event, such as waiters, assistants, and other support profiles. 
– Event Organization: Professionals specialized in planning and coordinating events, available to take charge of all or part of the process. 

 

2.11 Generic platform navigation (provider): 

This section describes the functionalities and options available to providers within their private space or extranet. 

– Extranet / Service panel: It is the private area accessed by each provider to manage and administer the services they offer through the platform. From here they can add, modify, or delete services, check details, and control their offerings. 

– Community: A section where providers can interact with each other and with other related agents. Experiences, best practices, or news can be shared. 

– “My events” – Reservations: Here the provider can view and manage all reservations made by clients for their services. It includes information such as dates, event details, reservation status, and options to confirm, cancel, or modify reservations. It also allows management of modifications, claims, and reviews from clients and other providers. 

– “My events” – Transactions and payments: This area allows the provider to consult all economic transactions related to their services, including received payments, invoices, applied commissions, and payment statuses. 

– Switch to client mode (Company/Entity): This function allows the provider to switch their profile to client mode, in order to contract services offered by other providers within the platform, either as a company or entity, thus facilitating comprehensive management of their events from a single account. 

 

2.12 My events/reservations (provider): 

This is the section where the provider can see a complete list of all contracted services and related requests, along with the events they are linked to. From there, they can access each specific event and, if the client allows, consult information about other participating providers and their contributions. 

Additionally, the provider can manage their reservation within the event, including modifications, new requests, cancellations, and claims, as well as all details related to the specific service they offer in that event. 

 

2.13 Reservations (provider): 

2.13.1 Reservation settings 

Direct reservations: Do not require confirmation by the provider; the reservation confirmation is direct and will depend on the type of reservation and applicable cancellation policies. 

Non-direct reservations: The provider has the right to reject or accept client reservations. 

Legitimate reasons to reject a reservation: The provider may reject reservations for reasons such as admission rights, price errors, lack of availability, adverse weather conditions, logistical problems, or client breaches, always justified and with the corresponding notice. A high volume of rejections or cancellations by the provider may entail penalties according to the General Terms and Conditions. 

2.13.2 Modifications and management of reservations/services: 

See the section later on “Modifications and management of reservations/services for clients and providers.” 

2.13.3 Payments and commissions 

For each service reservation formalized by a Client through the Platform, the Provider must pay EVENTSTUR a commission (the “Commission”). Review this point in the General Terms and Conditions. 

For each reservation formalized through EventstuR, the provider pays a commission on the base price of the contracted service (excluding taxes and extras). This commission is previously stipulated in the agreement signed with the provider and varies according to the type of service offered. 

How is it calculated? Multiply the number of reserved services by the base price of each and apply the agreed commission percentage (plus taxes if applicable). 

The payment of the commission is done automatically and transparently, whether the client pays the amount through the portal or directly to the provider. In both cases, EventstuR withholds or receives the corresponding commission according to the conditions established in the contract signed with each provider. 

In addition to the commission for reservations, some additional services, such as the 360º Tour, 2D and 3D layout of spaces, or any other special service offered by EventstuR, may generate specific additional charges. These services are billed separately and managed according to the agreed terms.

2.14 Specific navigation for providers: 

Each provider has an extranet where they can manage all their services. Depending on the categories (for example, DJ, catering, space, furniture, etc.), the platform will show different fields, functionalities, and options tailored to their specific needs to register each service. 

Moreover, a provider can belong to more than one category simultaneously, being able to manage multiple services in each within the same account to independently and efficiently administer all the services they offer. 

Providers can distinguish and adapt their offer depending on the agent organizing the event and the type of event selected, as well as create variants of the same service to better adjust to different needs. 

Likewise, they have the possibility to establish all payment methods, commercial policies, detailed information, image galleries, offer and promotion systems, among others. 

Finally, in this same section, they can access the “Collaborating companies” section, where they will find pre-established contracts by EventstuR that facilitate the legal and administrative management with other agents and clients within the legal framework of EventstuR (and which they can use as templates to establish them outside), or reproduce those they already have outside within the portal. 

In some cases, there are services that EventstuR can offer at an additional cost: 2D/3D layout of your space, 360º tour, management of your events, among others that you can find on the portal itself. 

 

2.15 Community 

See the next section “2.16 Community.” 

 

2.16 Community: 

The EventstuR Community section functions as an internal social network of the platform, designed to share real experiences, inspire other users, and give visibility to the work of providers. 

From this space you can: 

  • Post photos and videos of your completed events. 
  • Tag the providers who participated, recognizing their work and facilitating future collaborations. 
  • Explore posts from other users and providers, discover ideas, styles, and outstanding professionals. 
  • Comment and interact with other community members to generate synergies, resolve doubts, or connect. 
  • Get inspired through community-generated content about real events managed from EventstuR. 

Additionally, both your profile and your posts allow selecting the privacy level: 

  • Public: visible to all users inside and outside the platform. 
  • Followers only: only your followers within EventstuR can see it. 
  • Private: only you can see the post or profile until you decide to change its visibility. 

This space fosters trust, professional visibility, and collaboration within the EventstuR ecosystem. 

 

2.17 Rating and reputation system 

Once the service and event have ended, both clients and providers will find a “Rating” section within each reservation in the “My events” section, where they can rate the people they have worked with. 

The rating is done through a star system (from 1 to 5) and a space to add comments. The rating fields are defined by EventstuR to ensure homogeneous evaluation criteria. 

EventstuR reserves the right to intervene and remove any comment it considers offensive, inappropriate, or contrary to the platform’s coexistence rules. 

2.18 Modifications and management of reservations/services by clients and providers 

Once the reservation is confirmed, it is possible to make modifications regarding aspects such as the number of attendees, the date, or the contracted services. 

2.18.1 Modify a reservation 

If you are the client and make changes: 
You can use the “Modify and update” option. 

If extra or complementary services are added (such as additional decoration, drinks, etc.) that affect the price, approval from the provider will not be necessary if they offer direct booking, and the corresponding payment will be made; however, it will have to be approved by the provider if it is a reservation upon request, following the booking procedure described in the previous section. 

If changes are added that do not affect the price or are minor, provider approval will not be necessary, and the provider will only be informed. 

If the provider has made the changes: 
You will see the “Accept” option to decide whether to accept or reject the proposed modification. 

2.18.2 Cancellation of the reservation by the client 

If a client wishes to cancel a reservation, they may do so provided they notify through the channel enabled in the “My events” section, within the corresponding reservation. 

Cancellation will be subject to the cancellation costs indicated at the time of formalizing the reservation, which may vary depending on the provider and the type of service. 

In case of cancellation within 72 hours prior to the service provision, it will not be possible to cancel the reservation nor will any refund be made, except for justified cause. In these cases, the client must contact EventstuR directly to review the situation. 

We recommend reading carefully the specific terms and conditions regarding cancellations before confirming any reservation. 

2.18.3 At the end of the event 

Rating: After the event, both the client and providers will be able to leave ratings. 

Claims and refunds management: The option to manage possible incidents or request refunds will be activated if applicable. 

2.19 Claims and non-payments 

2.19.1 Claims (providers and clients) 

In case of incidents between the client and the provider, EventstuR is not responsible, and both parties must manage it directly. EventstuR acts only as a communication channel, without assuming responsibility for the content or outcome of the claim. 

If the provider acknowledges their responsibility, they may offer compensation to the client through the platform, within a maximum period of 14 days. If the client does not accept it, they may take any actions they deem appropriate, without any liability for EventstuR. 

Claims must be submitted within 15 days from the incident date, through the “Claim” section within the specific reservation in “My events” on the platform, which will generate a ticket that will be notified to the other party.

2.19.2 Non-payments 

If the client does not have sufficient funds in their account for the automatic payment to be processed, the reservation will not be made. For claims or extra services after the event, the client will have a maximum period of 14 days to have the corresponding amount available. 

Whether the payment is made directly to the provider or to EventstuR, the provider must manage the claim with the client independently, without EventstuR assuming any responsibility and still charging the commission. 

Therefore, EventstuR will not be responsible, and the provider must assume the debt and still pay the corresponding commission to EventstuR. 

On the other hand, if the provider does not have sufficient funds in their account for the automatic payment of the commission to EventstuR, they will also have a period of 14 days to have the necessary amount available. 

If after this period the provider does not pay the commission, consequences will apply which may include account blocking and corresponding legal actions. 

2.20 Provider Display Order System (DO) 

The order in which providers appear in search results and categories is generated automatically, prioritizing comprehensiveness, activity, and customer satisfaction. Initially, with no data available, each time a client opens the platform a different provider will appear, allowing the client to filter from there. 

Rotating Main Position: As mentioned, the first visible provider/product upon entering EventstuR will rotate with each new user to ensure fairness. 

Prioritization Criteria for the General DO: The rest of the display order will be based on a weighted combination of the following factors: 

  • Profile Completeness: Providers with more fields completed in their EventstuR description (including subcategories and offer percentages) will have greater visibility. 
  • User Interaction: 
  • Number of clicks on their subcategories. 
  • Number of completed bookings in their subcategories. 
  • Times their profile has been searched directly. 
  • Quality and Quantity of Reviews: Both the volume and average rating from clients and other providers are considered. 
  • Activity on the Platform: Regular posts and updates in the provider’s “My Profile” section on EventstuR. 
  • Penalties Affecting Positioning: To maintain high quality standards, penalties will be applied that reduce a provider’s ranking in cases of: 
  • Unjustified booking cancellations. 
  • Poor ratings (1–2 stars). 
  • Number of claims: Accepted claims will incur a minor penalty, while unaccepted claims will result in a greater penalty. 

 

2.21 Communication Between Providers and Clients 

EventstuR facilitates direct, clear, and professional communication between clients and providers through integrated platform channels, according to the timing and needs of each booking: 

2.21.1 Internal Chat 
Each booking has an exclusive chat within the “My Events” area, allowing both parties to: 

  • Exchange written messages. 
  • Share documents, proposals, and modifications. 
  • Accept or reject specific requests (date changes, reduction of attendees, etc.). 
  • Request and confirm extras (additional decoration, extended hours, etc.) that do not require approval if added from a direct booking. 

2.21.2 Visits and Meetings Scheduler 
From the booking itself or the provider’s profile, both clients and providers can: 

  • Propose and schedule in-person visits to the venue. 
  • Arrange video calls directly via the platform. 
  • Confirm or reschedule appointments through mutual request and validation. 

2.21.3 Calls and Direct Contact 
EventstuR allows the provider’s contact phone number to be shown if authorized, to facilitate direct calls when necessary. This option is especially intended for urgent management or last-minute confirmations. 

2.21.4 “My Events” Panel 
This panel is the operational hub for each user (client, provider, or organizer) and allows: 

  • Viewing all active, completed, or ongoing bookings. 
  • Accessing conversation history, confirmations, payments, modifications, or cancellations. 
  • Managing payments, changes, claims, and reviews. 
  • Confirming attendance, validating extra services, or viewing payment links (QR, links). 
  • Automatically managing the collection of cancellation fees from the registered card when applicable. 

 

2.22 Contacting EventstuR: Incidents, Inquiries or Claims 

For any general incidents, inquiries, or claims addressed to EventstuR, we provide the “Contact EVENTSTUR” service through the eventstur360.com platform. 

Through this channel, users can open a support ticket that will be managed by our internal team. Once the ticket is created, a specialized professional will be assigned to accompany you throughout the resolution process. 

From that moment, you can communicate directly with the assigned professional via: 

  • Internal follow-up chat. 
  • Video call (by prior appointment). 
  • Telephone call, if necessary. 

Additionally, both providers and clients can count on our “Intelligent Chatbot,” available on the platform 24/7. This virtual assistant is designed to respond quickly and accurately to the most frequent queries about platform operation, booking processes, payments, modifications, cancellations, and more. The chatbot is ideal for resolving immediate doubts without needing to wait for personalized assistance, and can escalate to human support if necessary. 

Also, in the “Explainer Videos and FAQs” section available at eventstur360.com, both clients and providers will find: 

  • Step-by-step visual guides to understand how the platform works. 
  • Clear answers to frequently asked questions organized by topic (bookings, payments, cancellations, communication, profile usage, etc.). 

This section is intended as a self-help resource so users can manage their EventstuR experience autonomously, quickly, and efficiently. 

Our goal is to provide personalized, fast, and efficient support at all times. 

 

  1. Security and Trust

3.1 Profile Verification 
As previously mentioned, EventstuR has a verification system for both clients and providers. This process guarantees the authenticity and reliability of users on the platform, contributing to a safe and transparent experience for all parties. 

3.2 Data Protection and Privacy 
At EventstuR, the protection of personal data and the privacy of our users is a priority. We have strict policies and measures to ensure the appropriate and secure handling of information in accordance with current regulations. For more details, we recommend reviewing our Data Protection and Privacy Policy available on the platform. 

3.3 Fraud Prevention 
At EventstuR, we work to guarantee a safe and trustworthy experience for all platform users, both clients and providers. For this reason, we have implemented fraud prevention measures that include identity verification, the use of secure payment gateways, and a rating and reputation system based on real experiences. 

3.3.1 Security Recommendations for All Users: 

  • Never complete payments outside the platform if the provider or client was found through EventstuR. External dealings are not covered by our protection policies. 
  • Avoid sharing sensitive personal data (such as passwords, full card numbers, or bank accounts) through unofficial messaging channels. 
  • Do not accept or send suspicious links outside the platform. 
  • Immediately report any suspicious behavior, impersonation attempts, or fraud through the official contact system or the “Claim” section. 

3.3.2 Measures Applied by EventstuR: 

  • Verification and review of registered provider and organizer profiles. 
  • Automated systems to detect anomalies in bookings and payments. 
  • Data protection and encrypted communications. 
  • Active incident and claim management, with personalized support if necessary. 

Any irregularity or suspicion can be reported through our user support system at eventstur360.com, where a ticket will be opened and a support professional assigned.

3. DATA PRIVACY GUIDELINES (the “Guidelines”) 

  1. SCOPE, DEFINITIONS AND INTERPRETATION

1.1 Origin 

1.1.1 Unless otherwise provided in the Guidelines, the terms and conditions of the Agreement shall remain unaltered and in full force and effect. 

1.2 Services of eventstur360.com 

1.2.1 The Provider is aware that eventstur360.com, based in Barcelona (Spain), operates the Service. 

1.2.2 If the personal data related to customer bookings, including but not limited to booking details, requests and updates, as well as order data (“Customer Personal Data”), is not processed exclusively and directly by the Provider (as may be the case, for example, where the Provider is or represents a chain, event management company, etc.), this Annex shall apply to the Provider ultimately processing the Customer Personal Data. eventstur360.com may consider the Provider (whether or not the contracting entity) to be the (sole) Data Controller of the Customer Personal Data processed in the context of the Agreement. 

1.3 Notifications 

1.3.1 Unless otherwise provided in the Guidelines, any notice or correspondence from Providers in relation to the Guidelines shall be sent via EVENTSTUR in the “Contact Eventstur” section and its corresponding ticket system. 

 

  1. PRIVACY AND DATA PROTECTION

2.1 Relationship 

2.1.1 When a Party processes Personal Data in the context of the Agreement, it does so for its own purposes as an independent and separate Data Controller and shall be solely responsible for its own compliance with Technology and Data Legislation. 

2.1.2 If eventstur360.com transmits or makes Personal Data available to the Provider pursuant to the Agreement, the Provider acts as an independent and separate Data Controller in relation to its own processing of such Personal Data, regardless of whether such data is obtained directly or indirectly via a connectivity Provider. 

2.1.3 Neither Party processes Personal Data on behalf of the other Party. The Parties have not jointly determined the purposes and means of any Personal Data processing in the context of the Agreement. 

2.1.4 Notwithstanding the foregoing, if the Parties jointly determine the purposes and means of any processing activity in the context of the Agreement, they shall in good faith determine their respective responsibilities for compliance with obligations under Technology and Data Legislation. 

2.2 Sharing Personal Data 

2.2.1 The Provider agrees to transmit or make available to eventstur360.com the Personal Data where such disclosure is permitted under applicable law, including Technology and Data Legislation. 

2.2.2 The Accommodation may request eventstur360.com to disclose Customer Personal Data to other collaborators, service providers, or affiliates of the Provider (“Provider Collaborators”), or to systems where Accommodation Collaborators may access such Personal Data to manage or facilitate the booking between the Customer and the Provider. Such disclosure must be made solely on behalf of and under the instructions of the Provider, which the Provider may modify at any time, and shall not be interpreted as a disclosure made by eventstur360.com. The Provider declares and warrants that it has all necessary rights, authorizations, and permissions to disclose such Customer Personal Data to those Provider Collaborators. 

2.2.3 Each Party may transmit or make Personal Data available to its Affiliates where such disclosure is permitted by applicable law, including Technology and Data Legislation. 

2.2.4 The Parties understand and agree that eventstur360.com will transmit or make available to the Provider the Customer Data and the Customer Personal Data. The Provider shall process the Customer Data and Customer Personal Data only to the extent necessary to fulfill its obligations under the Agreement, as agreed between the Parties in writing, if the Provider has a legal basis which includes the Customer’s consent where necessary, and always in accordance with Technology and Data Legislation. 

2.2.5 eventstur360.com will only transmit or make the Customer Personal Data available to the Provider through a connectivity Provider in accordance with the conditions of the Agreement and based on the following: 

(i) the connectivity Provider shall be contracted by the Provider to provide the connectivity Services and shall act as a data processor (i.e., a natural or legal person, public authority, agency, or other body that processes Personal Data on behalf of the Data Controller) for the Provider; 

(ii) the Provider requests eventstur360.com to transmit or make the Customer Personal Data available to the connectivity Provider (for processing for the purposes solely set by the Accommodation) rather than directly to the Provider; and 

(iii) the connectivity Provider shall not process any Customer Personal Data on behalf of eventstur360.com. 

2.2.6 eventstur360.com will make the Customer Personal Data available to the Provider on the Extranet for a period of thirty (30) days (or by any other means and for any other period as determined by eventstur360.com and notified to the Accommodation in advance) after the end of service delivery to a Customer or the cancellation date. eventstur360.com shall have no obligation to make the Customer Personal Data available to the Accommodation beyond this point. 

2.3 Transparency 

2.3.1 Each Party shall process the Personal Data of/about the other Party (and/or any person acting on its behalf) in accordance with the privacy policy made available to data subjects in a transparent manner prior to or at the time of collection of that Party’s Personal Data or, as permitted by Technology and Data Legislation, promptly thereafter. The Provider may refer to its own privacy policy in relation to Customers and their Personal Data within the information published through the Service. 

2.3.2 eventstur360.com shall process any Personal Data collected and related to the Accommodation and/or any person acting on its behalf in accordance with the eventstur360.com Partner Privacy Policy (available on the Platform) and as amended by eventstur360.com from time to time. 

2.3.3 The Accommodation warrants that, in accordance with Technology and Data Legislation, when it provides Personal Data to eventstur360.com, it has informed its staff members, agents, representatives, and other persons about the collection and, where necessary, obtained their consent for the processing of their Personal Data by eventstur360.com in relation to the Agreement. 

2.4 Cooperation 

2.4.1 Each Party shall provide all reasonable cooperation, assistance, and information to enable the other Party to comply with its obligations under Technology and Data Legislation, at its own expense. Each Party shall assist the other Party to: 

(i) respond to requests from the competent authority (including supervisory authorities) regarding the Personal Data processed and shared in the context of the Agreement; 

(ii) respond to data subject requests wishing to exercise their privacy rights, including their rights under Technology and Data Legislation; 

(iii) carry out assessments to validate compliance with applicable law, including Technology and Data Legislation. 

2.5 Data Transfers to Third Countries 

2.5.1 The Parties shall ensure that Personal Data is only transferred to or accessed by recipients outside the European Economic Area (“Third Country”) if such transfer complies with applicable Technology and Data Legislation. 

2.5.2 In the case of any transfer to a Third Country, the Parties shall ensure that, where the European Commission has not recognized the destination country as providing an adequate level of data protection, the Parties put in place appropriate technical, organizational, and contractual measures to comply with Technology and Data Legislation. 

2.5.3 The Parties acknowledge that any transfer of Personal Data by eventstur360.com under the Agreement is necessary for one or both Parties to conclude or perform a contract with the Customer and/or is in the Customer’s interest, without prejudice to the Parties’ right to determine that for certain transfers, another legal basis for transfer may also apply. 

2.5.4 If any authority in a Third Country makes a request for access to the Personal Data, the Party receiving the request agrees to properly assess its legality and legitimacy before responding, and to take appropriate measures in response. 

2.6. Data processing through the use of proprietary Artificial Intelligence systems 

For the same purpose, legitimate interest and under the same conditions set out in the preceding paragraphs, the Provider voluntarily authorizes and consents to eventstur360 processing its personal data through its own automated Artificial Intelligence systems, always following the principles below: 

2.6.1. Lawfulness, fairness and transparency. All processing must have a clear and understandable legal basis. 

2.6.2. Purpose limitation and minimization of use, which shall be used exclusively for the provision of services related to the contract entered into between the parties. 

2.6.3. Proactive accountability. 

The user has the right to access, rectify and delete personal data that, by virtue of this authorization, has been used for processing through Artificial Intelligence systems. 

The consent verified by this document is revocable at any time, in whole or in part. 

Our system applies protection measures, such as pseudonymization and anonymization. 

 

 

4. SECURITY AND DATA BREACHES 

  1. Security Measures 

1.1 Each Party shall implement and maintain appropriate technical and organizational security measures: 

(i) to safeguard the confidentiality, integrity, availability, and continuity of the Personal Data and Confidential Information transmitted, stored, or otherwise processed in the context of the Agreement (whether under the direct or indirect control of such Party), in accordance with prevailing high industry security standards, particularly through measures such as encryption and pseudonymisation (especially in the context of any international transfer of Personal Data); 

(ii) to detect, remedy, and prevent security breaches that lead to the destruction, loss, alteration, unauthorized use, transfer, disclosure, or unlawful or accidental access to such Confidential Information or Personal Data transmitted, stored, or otherwise processed in the context of the Agreement (“Security Incident”), taking into account any trends related to Security Incidents in the industry and in accordance with applicable laws, the state of the art, and industry standards, including, in particular, monitoring systems, alert systems, backup procedures, and firewalls; 

(iii) to comply with relevant best practices for physical security and information security in relation to such Confidential Information and Personal Data. 

1.2 The Provider shall not carry out any act or omission that has or can reasonably be expected to have an adverse impact on the security of the Service or System. 

1.3 Each Party shall use all reasonable efforts to: 

(i) ensure that its computer systems, databases, servers, API connections, and integrations do not disable the other Party’s software, hardware, or security measures or contain any material that could have a detrimental, harmful, or adverse effect or cause damage to the other Party, including, without limitation, worms, viruses, trojans, corrupted files, cracks, bugs, unauthorized or hidden programs, or other materials; 

(ii) prevent and detect third-party social engineering activities, including account takeovers, that may result in a Security Incident related to the Extranet; and 

(iii) safeguard and maintain the Extranet user ID and password confidentially and securely, and shall not disclose the user ID and password to any persons who do not need access to the Extranet to fulfill their work responsibilities. 

  1. Security Incidents and Personal Data Breach 

2.1 If the Provider becomes aware of or has reasonable grounds to suspect that a Security Incident may have occurred that could jeopardize the Platform or the systems, databases, information, data, servers, connections, integration, the eventstur360.com website, as well as the Extranet and any Confidential Information or Personal Data stored, transmitted, or otherwise processed in the context of the Agreement, including through a connectivity Provider, the Provider shall: 

(i) immediately take all reasonable and appropriate actions required by the situation, even before consulting with eventstur360.com under Clause 2.1 (ii), to prevent, avoid, or mitigate any harm or adverse effect to eventstur360.com and the Clients; and 

(ii) notify eventstur360.com through https://report.eventstur360.com without undue delay and always within 24 hours of any actual or suspected Security Incident, and consult with eventstur360.com regarding the reasonable and appropriate actions to be taken, without prejudice to Clause 2.1 (i); 

(iii) subject to limitations under applicable law, be responsible for proactively providing all necessary information to eventstur360.com to ensure that eventstur360.com remains fully informed and can conduct its own investigation related to the cause, mitigation measures taken, and damages incurred or likely to be incurred by the Parties and third parties in relation to the Security Incident; 

(iv) cooperate with eventstur360.com to take any reasonable and appropriate actions to address the Security Incident and mitigate the risk of a similar Security Incident occurring in the future. 

2.2 Subject to mandatory requirements under applicable law, the Provider: 

(i) shall use its best efforts to consult with eventstur360.com and take into account its reasonable requirements as to the timing, content, and form of disclosure or notification, and the recipient before making any disclosure or notification to any third party (including any supervisory authority) in relation to a Security Incident; 

(ii) acknowledges and agrees that eventstur360.com reserves the right to voluntarily report any Security Incident to any third party (including supervisory authorities and Clients); and 

(iii) shall not notify Clients or any other third party of a Security Incident involving Personal Data that eventstur360.com hosts or stores in the Extranet without the prior written authorization of eventstur360.com. 

2.3 eventstur360.com shall notify the Provider without undue delay in the event of any Security Incident that materially and adversely affects the Provider. eventstur360.com shall not be required to notify the Provider of any outage, general downtime, or other defect that does not specifically affect that Provider. 

Annex 4A 

FACILITATED PAYMENT CONDITIONS FOR ALL TRANSACTIONS 

  1. Scope, definitions and interpretation

1.1 This Annex 4A forms an integral part of the Agreement and must be read in conjunction with the Agreement. Unless otherwise stated in this Annex 4A, the terms and conditions of the Agreement shall remain unaltered and in full force and effect. 

1.2 Unless otherwise provided in this Annex 4A, capitalized terms shall have the same meaning as defined in the Agreement. References to Clauses in this Annex 4A shall refer to the Clauses of this Annex 4A unless otherwise specified. 

  1. Facilitated Payment

2.1 eventstur360.com may offer Facilitated Payment services. In some cases, eventstur360.com may contract a third party to facilitate and process payments under Facilitated Payment (the “Payment Processor”). eventstur360.com engages Payment Processors to collect payments from Clients and to transfer and settle funds with Providers. 

2.2 Payments made by a Client to eventstur360.com or to a Payment Processor, in its role as agent of the Provider, shall satisfy the corresponding amount of the debt the Client has with the Provider. 

  1. Service Price

3.1 The Payment Processor will collect and process the Service Price, in accordance with the Provider’s payment terms (to the extent applicable) as disclosed on the Platform. 

3.2 The Provider shall not charge, request payment from, or receive from the Client any amount not already included in the Service Price (base price + extras), unless eventstur360.com has indicated that certain Taxes, fees, charges, additional services, or other amounts are not included in the Service Price (“Extras to the same provider’s base price”). 

3.3 eventstur360.com will transfer the Service Price to the Provider pursuant to the rules set out in Clauses 3.3, and 6.1 to 8.1 of this Annex. One of the following amounts, as timely agreed upon between the Parties, will be transferred to the Provider: 

(i) the balance after deducting from the Service Price the outstanding Commission (if permitted), fees, costs, and other amounts owed to eventstur360.com, or the equivalent of such result in another currency (the “Net Amount”); or 

(ii) the result of deducting from the Service Price the amounts eventstur360.com is required to withhold under local laws and regulations, or the equivalent of such result in another currency (the “Gross Amount”). 

  1. Use of Facilitated Payment funds

4.1 eventstur360.com may occasionally use Facilitated Payment and/or other (online) payment methods such as virtual credit cards for: 

(i) (pre)payment of the product or service Price by the Client to the Provider via the Payment Processor; 

(ii) settlement and/or payment of any Commission, Facilitated Payment Charges, and/or other amounts owed to eventstur360.com for the product or service; and 

(iii) offsetting any Commission, Facilitated Payment Charges, and/or other amounts owed to eventstur360.com for the product or service against the Price processed at any time via the Payment Processor. 

4.2 If the funds are insufficient to settle and pay all amounts owed to eventstur360.com, eventstur360.com may charge the shortfall via direct debit (if available), or else, after the first request by eventstur360.com, the Provider shall pay the shortfall into the bank account identified by eventstur360.com at any given time. 

  1. Taxes

5.1 Unless applicable law requires otherwise and until eventstur360.com states otherwise in writing, the Provider shall be responsible for collecting, remitting, withholding, and paying: 

(i) the applicable Taxes on the Service Price and on extras and amounts not included in the Service Price; and 

(ii) the Taxes on the Commission. 

5.2 If in accordance with Clause 4.1 of this Annex, eventstur360.com uses the Service Price of a product or service collected from a Client for the settlement and payment of any Commission, Facilitated Payment Charges, and/or other outstanding amounts owed by the Provider, the latter shall still fulfill its tax obligations related to the provision of the service to the Client, unless the applicable law states that eventstur360.com is the taxable entity. 

  1. General rules for any transfer

6.1 eventstur360.com may suspend payment of the Net Amount or the Gross Amount without notice if fraud or other illegality associated with the transaction is suspected. Client bookings suspected of alleged fraud will be cancelled. In the event of cancellation of a non-refundable Client booking, the Provider will still receive the payment, provided there is no alleged suspicion of involvement by the Provider. 

6.2 Notwithstanding Clause 6.1, payment of the Net Amount or the Gross Amount may be suspended if eventstur360.com suspects the Provider is in breach of the Agreement. 

6.3 Any Net Amount or Gross Amount held by a bank, Payment Processor, or third party under this Annex shall not accrue interest. 

6.4 If the Provider includes the Service Price in a specific currency, they will receive that amount in that currency. If the Provider attempts to accept settlement or payment of the product or service Price into an account denominated in a currency different from the product or service Price, or otherwise attempts their own currency conversion of the settlement amount, the Provider shall bear all currency exchange risks, including conversion of the product or service Price. The Provider agrees and acknowledges that, due to currency exchange rate fluctuations and costs and charges levied by banks, credit card companies, and other intermediaries for the collection, processing, and payment of relevant amounts, there may be discrepancies between the product or service Price (as posted in the system by the Provider), the amount collected, and the amount received by the Provider. 

6.5 If, for any reason, eventstur360.com is required to refund all or part of the Service Price to the Client, or reasonably believes that fraudulent activity by the Provider has occurred, eventstur360.com reserves the right to claim back from the Provider the refunded amount paid to the Client but already received by the Provider. Payment by the Provider under this Clause 6.5 shall be made within 14 days of eventstur360.com’s request. 

6.6 To the extent that the Provider agrees to refund a non-refundable Service Price paid in whole or in part (or part thereof), eventstur360.com may settle the relevant amount with the Client on behalf of the Provider. To the extent that the relevant amount has already been transferred to the Provider under this Annex, the Provider shall refund such amount to eventstur360.com as reasonably requested. To the extent that the relevant amount has not been transferred to the Provider under this Annex, eventstur360.com will not transfer it and/or will have the right to block its transfer. 

6.7 eventstur360.com may charge a Commission on the product or service Price collected and transferred to the Provider in the event of a no-show or cancellation by the client. 

6.8 The Provider shall issue an invoice to the Client for the full amount of the booking (including/all applicable Taxes as required by applicable law). The Provider shall not invoice eventstur360.com for any item. Nothing in the Agreement shall constitute or imply that eventstur360.com acts or operates as the principal, merchant, or (re)seller of the service. 

  1. Payment via Virtual Card

7.1 The Provider may not authorize or charge the Virtual Card until the date on which the Client’s Booking becomes non-refundable or, notwithstanding the other rights of eventstur360.com under this Agreement, except where there is a well-founded suspicion of a risk in the payment of the service, such as chargebacks, suspected fraud, or other circumstances associated with the transaction conducted by the Client that may be deemed unlawful or legitimate. 

7.2 The Virtual Card is only valid for the booking, amount, and currency specified in the booking confirmation to which it was assigned. The Provider shall charge the Virtual Card for the Gross Amount within a maximum of 12 months from the date the service was provided (the “Cut-off Date”). Before the Cut-off Date, eventstur360.com will make commercially reasonable efforts to inform the Provider about the Gross Amount or any part thereof that the Provider may already charge. By informing the Provider of the Gross Amount (or part thereof) that the Provider may already charge, eventstur360.com shall fulfill all its notification obligations to the Provider under applicable law. 

7.3 If the Provider fails to charge the Gross Amount by the Cut-off Date or on the Cut-off Date: 

(i) the Virtual Card will be deactivated; 

(ii) the Provider’s rights and claims to such amount (including any right of set-off) shall automatically cease to exist; and 

(iii) eventstur360.com shall have full right, title, and interest in such amount. 

7.4 From the Cut-off Date, the Provider, without further action, hereby definitively waives eventstur360.com from any liability regarding any claims relating to the Gross Amount (including explicitly any claims regarding the Gross Amount—or any part thereof—to the extent it was not charged by the Accommodation before the Cut-off Date). The Parties expressly agree that the Gross Amount (or any part thereof) retained by eventstur360.com after the Cut-off Date does not constitute a Commission or any other contribution paid by the Provider to eventstur360.com for the provision of Services under the Agreement. 

  1. Payment via Bank Transfer

8.1 The Provider must provide eventstur360.com with correct Bank Account information. eventstur360.com shall transfer the Net Amount or the Gross Amount to the Bank Account. The Provider shall bear all risks arising from providing incorrect information to eventstur360.com, such as incorrect Bank Account details. Payment of the Net Amount or the Gross Amount via bank transfer will be made within 14 days following the end of the month in which the service was provided, unless otherwise stated by eventstur360.com. The Provider may request eventstur360.com to change the payment method from bank transfer to Virtual Card for future Service Price payments.
